A lawsuit filed by the family of a New Jersey man who died after a double lung transplant three years ago in Philadelphia has been expanded to include Lancaster General Hospital.

The man, 43-year-old Tony Grier, of Newark, died about six months after receiving the organs from a Lancaster County accident victim, according to reports from Channel 2, a CBS-TV station in New York City and other sources.

The family claims the lungs were cancerous.

The crash victim was identified in the reports as Tara Rivera, 31, of Lancaster.

The woman had been critically injured in a three-vehicle crash that happened Jan. 5, 2005, on Lincoln Highway East, according to newspaper records.

According to the CBS story and newscast, Grier's mother, Emma, alleges that her son was told by HUP that he was getting healthy lungs from a teenage boy.

Emma Grier is further contending that HUP doctors initially misdiagnosed the cancer in her son as an infection, and that the donor should have been identified as inappropriate because she smoked a pack of cigarettes a day, according to the report.
